Washington state man sentenced for burglary and assault on Cherokee Nation Reservation

MUSKOGEE, OKLAHOMA – The United States Attorney’s Office for the Eastern District of Oklahoma has announced that Cody Lynn Lusk, a 35-year-old resident of Seattle, Washington, received a sentence of 84 months in prison for one count of burglary in the first degree in Indian Country. Additionally, Lusk was sentenced to 30 months for one count of assaulting a spouse, intimate partner, or dating partner by strangling and suffocating in Indian Country.

The charges stemmed from an investigation conducted by the Federal Bureau of Investigation, the Cherokee Nation Marshal Service, and the Muskogee Police Department.

Lusk pleaded guilty to these charges on February 3, 2025. Investigators reported that on March 22, 2024, Lusk broke into an apartment in Muskogee with the intent to attack its resident. During this incident, he strangled and suffocated the victim. The victim managed to escape and call for help during a break in the assault. These events took place within Muskogee County on the Cherokee Nation Reservation in the Eastern District of Oklahoma.

The hearing was presided over by Chief U.S. District Judge Ronald A. White at the United States District Court for the Eastern District of Oklahoma. Lusk will remain under custody by the U.S. Marshals Service until he is transported to a designated United States Bureau of Prisons facility to serve his non-paroleable sentence.
