Nicholas Hammer, 47, previously residing in Tahlequah, Oklahoma, has been sentenced to thirty-eight months in federal prison for failing to register as a sex offender. The sentencing was announced by the United States Attorney’s Office for the Eastern District of Oklahoma.

Hammer pleaded guilty on March 25, 2025, after an investigation conducted by the United States Marshals Service and the Cherokee Nation Marshal Service. He had previously been convicted of first-degree rape on January 4, 2001, in Oklahoma and was required by law to register as a sex offender.

Investigators reported that Hammer did not register or update his registration from October 10, 2024, until November 4, 2024. During this period, he entered, left, or resided in Indian country within the Eastern District of Oklahoma without fulfilling his registration obligations.

Senior Judge Ronald A. White of the United States District Court for the Eastern District of Oklahoma presided over the sentencing hearing. Hammer will remain in custody with the U.S. Marshals Service until he is transported to a designated facility under the United States Bureau of Prisons to serve his sentence. There is no possibility for parole.

The case was prosecuted by Assistant U.S. Attorney Emily Wittlinger.
