Victoriano Ponce-Garcia, a 53-year-old Mexican national who was unlawfully present in Oklahoma, has been sentenced to time served for unlawful reentry after removal. The United States Attorney’s Office for the Eastern District of Oklahoma announced the sentencing.
Ponce-Garcia pleaded guilty on May 27, 2025. According to investigators, he was found in the United States on April 11, 2025, after having previously been removed from the country in both 2009 and 2020. He had not obtained consent from the Secretary of Homeland Security to reapply for admission.
The case resulted from an investigation conducted by U.S. Department of Homeland Security’s Immigration and Customs Enforcement Division and the Coalgate Police Department.
“This case is part of Operation Take Back America, a nationwide initiative that marshals the full resources of the Department of Justice to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime. Operation Take Back America streamlines efforts and resources from the Department’s Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN).”
Chief U.S. District Judge Ronald A. White presided over the hearing in Muskogee federal court. Assistant U.S. Attorney Dak T. Cohen represented the United States.
