TULSA, Okla. – U.S. District Judge Gregory K. Frizzell has sentenced Jose Luis Moreno-Yanez, a 39-year-old Mexican national, for the unlawful reentry of a removed alien. The sentence includes 78 months of imprisonment and three years of supervised release. Judge Frizzell specified that 39 months of this federal sentence will be served consecutively to his current state sentences for unrelated crimes. Following his release, Moreno-Yanez is expected to face removal proceedings.
“While Moreno-Yanez is unlawfully in the United States, his criminal history shows that he commits acts of violence,” stated U.S. Attorney Clint Johnson. “He has no regard for the laws in the United States and continues to show that he is a threat to lawful citizens. I commend the work of State and Federal prosecutors and law enforcement for working hard to keep our communities safe.”
In May and June 2023, Moreno-Yanez illegally re-entered the United States and was charged in two separate state cases for robbery with a firearm. He pleaded guilty in both instances and was additionally convicted on charges including possession of a controlled drug, assault and battery, among others. Consequently, he received concurrent sentences of 18 years and 20 years from the Oklahoma Department of Corrections.
Moreover, because Moreno-Yanez illegally re-entered while under federal supervision terms, he pleaded guilty in federal court for violating these terms. A federal judge ordered him to serve an additional 24 months’ imprisonment.
The investigation was conducted by U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations, with Assistant U.S. Attorney David D. Whipple prosecuting the case.
