Henryetta man pleads guilty to involuntary manslaughter for fatal DUI crash

Daeshaun Jared Ickle Cobretti Small, a 22-year-old resident of Henryetta, Oklahoma, has pleaded guilty to one count of involuntary manslaughter in Indian Country. The charge is related to an incident on December 31, 2022, in which Small unlawfully killed a victim while operating a motor vehicle under the influence of alcohol and failing to devote full attention to driving. The offense took place in Okmulgee County within the Muscogee (Creek) Nation Reservation.

The maximum penalty for this charge is up to eight years in prison and a $250,000 fine.

According to the United States Attorney’s Office for the Eastern District of Oklahoma, “The Superseding Indictment alleged that on December 31, 2022, Small unlawfully killed the victim in the commission of an unlawful act not amounting to a felony, that is failing to devote full time and attention to driving and operating a motor vehicle under the influence of alcohol and in the commission in an unlawful manner and without due caution and circumspection of a lawful act, that is, operating a motor vehicle, which might produce death.”

The investigation was conducted by the Oklahoma Highway Patrol and the Federal Bureau of Investigation.

U.S. Magistrate Judge D. Edward Snow accepted Small’s plea and ordered a presentence investigation report. Sentencing will be determined by a U.S. District Court Judge after reviewing federal sentencing guidelines and other statutory factors.

Small remains free on bond with conditions pending his sentencing. Assistant U.S. Attorneys Kevin Gross and Jonathan E. Soverly are representing the government in this case.
