Criminal case against Epic Charter Schools co-founders set to proceed in February

The criminal case against Ben Harris and David Chaney, co-founders of Epic Charter Schools, is proceeding after earlier delays. Oklahoma Attorney General Gentner Drummond announced that the prosecution is moving forward following unsuccessful efforts by the defendants to have the trial judge removed. The court has now set new dates for testimony, scheduled for February 25-27, 2026.

“We remain fully focused on presenting the facts and evidence in this case,” Drummond stated. “We are committed to ensuring that no one sidetracks justice or evades accountability.”

Harris and Chaney are facing charges including racketeering, embezzlement, and obtaining money by false pretenses. These charges stem from a lengthy investigation conducted by the Oklahoma State Bureau of Investigation as well as an audit led by State Auditor and Inspector Cindy Byrd.

The legal proceedings were previously delayed due to motions filed by the defense but will now continue according to the newly established schedule.
